The granting of sentence remission to terrorism convicts in Indonesia is a complex issue because it involves prisoners’ rights, national security, and justice for victims. This complexity gives rise to problems related to the mechanism, legal basis, and implementation of remission for terrorism convicts within the context of the modern correctional system. The objective of this study is to analyze the policy on granting remission in terms of substantive and administrative requirements, as well as to examine the effectiveness of deradicalization programs as a prerequisite for terrorism inmates (terrorist prisoners) who receive remission. The research employs a qualitative method with a normative juridical approach and a case study at Class IIB Tulungagung Correctional Facility. Data were collected through the examination of legal documents, official reports from the Directorate General of Corrections, data from the National Counterterrorism Agency (BNPT), and coverage from credible media outlets. The findings indicate that remission for terrorism convicts at Tulungagung Correctional Facility is granted after the fulfillment of administrative requirements, participation in deradicalization programs, and the declaration of allegiance to the Unitary State of the Republic of Indonesia (NKRI). The case of an inmate with the initials WD, who received additional remission and was fully released in March 2024, serves as evidence of the implementation of this policy. However, the study also identifies challenges, including the lack of uniform standards for deradicalization assessment, limited public transparency, and weak post-release supervision. The study concludes that the granting of remission to terrorism convicts needs to be balanced with nationally standardized and measurable assessment guidelines, greater information transparency, and an integrated supervision system in order to maintain equilibrium between prisoners’ rights and public security.
